Terms & Conditions

These Terms and Conditions (the “Terms”) govern your access to and use of certain products, services and features made available through a web and mobile application (the “App”) belonging to and operated by 10xme Technology Inc. doing business under the name and style of GIG (the “Company,” “us,” “our,” and “we”) and/or its parent company, subsidiaries, affiliates, representatives and related persons, as applicable (collectively, the “GIG Group”).
The App, including the website located at gigrewards.co.za and all its subdomains (collectively, the “GIG Platform”), is the intellectual property and copyrighted work of the GIG Group. The GIG Platform may include certain functions, features and other services accessible or offered through the App, a mobile application and platform that allows users and members to earn rewards points called “GIG Points” by accomplishing various online tasks and missions.
Certain offerings, products, services and features in the GIG Platform may be subject to additional guidelines, terms, or rules, which will be subject to more specific terms and conditions. Without limitation to the preceding sentence, your submission of information, including personal information, through or in connection with the offerings, products, services and features in the GIG Platform is governed by the terms of our privacy policy as updated from time to time, available and accessible at gigrewards.co.za and which is integrated and incorporated to these Terms by reference (the “Privacy Policy”).
All such additional terms, guidelines, and rules, including our Privacy Policy, are incorporated by reference into these Terms and binding and enforceable legal contract between the Company and the end user(s) of the GIG Platform (“you,” the “Member,” or the “Members”). These Terms set forth the legally binding terms and conditions that govern your use of the GIG Platform. By accessing or using the GIG Platform, you are accepting these Terms, and you represent and warrant that you have the right, authority, and capacity to enter into these Terms (on behalf of yourself or the entity that you represent).
These Terms expressly cover your rights and obligations, and our disclaimers and limitations of legal liability, relating to your use of, and access to, the GIG Platform. We reserve the right, in our sole discretion, to make changes or modifications to these Terms and the GIG Platform at any time and for any reason. You will be subject to and will be deemed to have been made aware of and to have accepted any such changes by your continued use of the GIG Platform. If you do not agree with all of the provisions of these Terms, please do not access and/or use the GIG Platform.
A. GIG Program
- By creating and opening an account in the GIG Platform, or by using or continuing to use your account to receive and redeem any benefits or rewards offered by or associated with the GIG Platform, the Members shall be deemed to have read, understood and accepted these Terms, including all amendments that may hereinafter be made by the GIG Group in its sole discretion from time to time. Otherwise, if you do not agree to the Terms set forth herein, please do not create or open an account or cease using the GIG Platform.
- The GIG Platform is a rewards and loyalty program owned and administered by the GIG Group, where users and members—by performing or completing online tasks, transactions, activities, missions and the like—can earn reward points called “GIG Points” which can be converted into various rewards and prizes (the “Program”). The Members can also gain access to exclusive partner promotions or offers, and avail other privileges or opportunities in accordance with the rules and provisions set out below.
- By becoming a Member of the GIG Platform, you acknowledge and agree that member profile data, transactional data, behavioral data, responses to polls and surveys, and other activities that are related to the Program will be collected and used by the GIG Group. The data may be used to better understand the needs and preferences of the Member so that the GIG Platform will be able to operate and administer the Program effectively and, among other things, provide the Members with offerings, products, services and privileges that relate to their activities, interests and preferences.
- By joining the Program, the Member agrees to receive communications related to the operation of the GIG Platform, including information regarding available program-wide and personalized partner promotions and offers, polls and surveys, and other announcements, updates, and notifications, via contact points provided or availed by the Member, which include but are not limited to SMS, social messaging apps, and in-app push notifications.
- The Company reserves the right to implement changes, amendments, modifications and revisions (the “Changes”) to these Terms at any time and such amended version of the Terms shall be deemed effective at the time of posting or publication in the GIG Platform, whether through its website(s) or the App. At the sole discretion of the Company, the amended Terms may be given a retroactive effect. While the Company may choose to provide notification of such Changes in the Terms to the Member, it is still the responsibility of the Member to be aware of these Changes in the Terms before choosing to continue using or accessing the GIG Platform.
- The Member acknowledges and understands that the GIG Points have no monetary value and are not convertible to cash. There is likewise no guarantee that the GIG Points would be transferable between Members or accounts within the GIG Platform.
- The GIG Group may choose to add, remove, or modify any existing rewards offered in the Program or substitute a similar rewards or loyalty program, at any time and at its sole discretion, immediately upon notice to the Members.
B. Account and Membership
- Only individuals are eligible to open, create or register an account in the GIG Platform. No corporations, partnerships or other legal entities are eligible to enroll as Members. The account creation and registration process is generally as follows:
- The App may be made available by downloading the GIG application at the Google Play Store, Apple App Store or the Huawei App Gallery or through the GIG Platform website application atgigrewards.co.za.
- The minimum age requirement for membership in GIG Platform is the legal age of eighteen (18) years old. When you open or create an account with the GIG Platform, you represent and warrant that you are of legal age. However, enrollees or applicants who are not of legal age may be allowed to create or open an account provided that their parent or legal guardian contacts the representatives and administrators of the GIG Platform before opening or creating an account to provide a copy of their written consent to the opening or creation of the account. Minors or persons who are not of legal age shall not be allowed to proceed with the opening or creation of the account until such parental consent is given. The Company reserves the right to verify, suspend, terminate and take such other appropriate actions upon determining that a Member is not of legal age.
- During the sign-up process, enrollees or applicants may be asked to provide certain information such as a mobile number, username, email and/or account password. We may also request any information or data from you at any time if we have reasonable grounds to believe that you have failed to provide accurate data.
- A virtual account number may be issued upon successful membership enrollment or account creation shall be adequate as evidence or identifier of membership in the GIG Platform.
- Each Member may only have one account in the GIG Platform. Membership in the GIG Platform is not transferable to other individuals under any circumstances. The Company reserves the right to consolidate or merge multiple accounts without prior notice. If an existing Member inadvertently creates a new account by signing up using a different phone number, the Member may request to merge both accounts by contacting the representatives and administrators of the GIG Platform. Any request for merging of accounts will be subject to verification.
- The Member shall keep any password or passcode private and secure at all times and shall not reveal it to any third party. It is understood that the password or passcode is known only to the Member and as such, any transaction effected using the Member's password or passcode shall be conclusively presumed to be done by, or authorized by, the Member. Thus, the Member further agrees that the GIG Group shall not be liable, and the Member agrees to hold harmless and indemnify GIG Group, for any loss, damages or costs that the GIG Group, the Member or any third party may incur as a result of the GIG Group's implementation of the transaction effected using the Member's password or passcode. In case of loss, theft or unauthorized use of the mobile number used, the Members are responsible for informing the representatives and administrators of the GIG Platform immediately. Members shall remain liable for all use of their accounts and GIG shall not be responsible or held liable for any loss suffered by Members in relation to loss, theft or unauthorized use of their membership accounts.
- The Members acknowledge that any “User Content,” meaning any and all information and content (including personal data and personal information) that a Member provides, submits to, or uses with, the GIG Platform, shall solely be their responsibility. You assume all risks associated with use of your User Content, including the possibility of infringing upon the intellectual property of third parties and any reliance on its accuracy, completeness or usefulness by others, or any disclosure of your User Content that personally identifies you or any third party. You may not represent or imply to others that your User Content is in any way provided, sponsored or endorsed by the GIG Group. The Company is not obligated to backup any User Content, and your User Content may be deleted from the GIG Platform at any time without prior notice. You are solely responsible for creating and maintaining your own backup copies of your User Content if you desire.
- The Company reserves the right to terminate the account of any Member and all accompanying benefits including the forfeiture of GIG Points, at any time, at its sole discretion and without compensation, for such grounds and reasons including but not limited to the following:
- The Member has committed a material breach of any of the Terms;
- The Member has been inactive for a long period of time, which shall in all cases involve a period of inactivity or non-use for at least one (1) month, without any explanation or justification;
- The Member has abused or misused the benefits accorded by the GIG Group;
- The Member has misrepresented information provided to GIG Platform;
- The Member is alleged to be engaged in a sale or barter of GIG Points, rewards or prizes other than as authorized by the GIG Group; or
- The Member is alleged to have performed other inappropriate or fraudulent act(s) that are deemed detrimental to the interests of the GIG Group and its partner brands and merchants such as but not limited to product partners, earn and/or redemption partners, commission-based partners, point-conversion partners, and promotion partners (the “Partner” or “Partners”).
- The Members may, at any time close or cancel their membership by contacting the representatives and administrators of the GIG Platform, by requesting the deletion of their account through the GIG Platform, and/or by initiating the account deletion process themselves. If the Member desires to delete their account in the GIG Platform, the Member may access the GIG Platform and follow or undertake the appropriate steps and processes therein to initiate the account deletion process. To ensure that the account is not being deleted by mistake or by fraud, the Member may be asked to verify certain information and details relating to the deletion of the account. Once an account is deleted, all GIG Points earned by the Member will generally be forfeited and shall not in any way be transferable, convertible or redeemable.
- A Member will be duly notified of the closure or deletion of the account mainly through in-app push notifications, or the active mobile number registered with the GIG Platform. Membership in the GIG Platform shall automatically terminate, without need of notice, upon the death of the Member and any unused GIG Points shall be forfeited and shall not in any way be transferable, convertible or redeemable.
- All personal data of a Member shall be deleted after five (5) years from the date of the account closure and/or termination.
C. Earning GIG Points Through Quests
- Members shall be eligible to earn GIG Points by performing or completing online tasks, transactions, activities, missions and the like (the “Quests”) with the GIG Platform and/or its Partners, according to their respective earn mechanics set out in the GIG Platform and/or other offer materials. The Quests may include the following:
- Social Quests. These are Quests that may require the Member to perform certain actions in social media platforms such as commenting, liking or favoriting a post, following a Partner account and other similar social media activities.
- Gaming Quests. These are Quests that may require the Member to complete and accomplish in-game quests, missions and tasks including the initial registration and creation of a game account with a Partner.
- Learning and Education Quests. These are Quests that may require the Member to perform various activities relating to understanding a Partner's offering, products or services (as may be verified by certain testing and examination mechanics).
- Account Onboarding Quests. These are Quests that may require the Member to register, open or create an account with a Partner.
- GIG Points that may be earned or the formula for their calculation (the “Crown Reward Formula”) for any particular Quest will generally be stated and displayed in the App. Otherwise, the amount of GIG Points or the Crown Reward Formula shall be based on the calculation rate specified in the mechanics of the relevant Partner. The earn mechanics for each Partner is subject to modification at any time without prior notice.
- Members may refer to the relevant Partner's terms and conditions for the timeframe of crediting GIG Points earned from a qualifying transaction or activity. Members who do not receive their GIG Points within the specified timeframe may contact the representatives and administrators of the GIG Platform for further assistance.
- Members shall not be entitled to earn GIG Points if they fail to meet the requirements and accomplish the quests within the specified timeframe.
- The Company has the right to adjust GIG Points earned if a qualifying transaction or activity with the GIG Platform and/or its Partner is canceled and/or refunded.
D. Redeeming GIG Points for Rewards
- Members may redeem GIG Points for various rewards, benefits, privileges, advantages and rights offered in the GIG Platform by the GIG Group and/or its Partners, at their sole discretion (collectively, the “Rewards”), which may include, but is not limited to, promo loads, credits, vouchers, gift certificates, discount codes, freebies, coupons, raffle entries, payment for purchased products and/or services, and the like, according to the relevant redemption mechanics set forth in the GIG Platform and/or other offer materials. The redemption mechanics for each Reward is subject to modification at any time without prior notice.
- Members may redeem the GIG Points for Rewards subject to the limitations or conditions that the GIG Group may deem necessary to manage the fair distribution of the Rewards to the Members. These limitations and conditions may include but are not limited to:
- A minimum number of GIG Points required to redeem the Rewards;
- A maximum number of the Rewards that can be redeemed with GIG Points by a Member; and
- The required inclusion of the Member as a beneficiary or recipient of the redeemed service or product.
- The use of Rewards, after redemption, is subject to additional terms and conditions of the relevant Partner, including but not limited to the following:
- The Rewards cannot be converted back to GIG Points after redemption is confirmed;
- The Rewards must be used within its validity period as published; and
- The Members shall have no claim against GIG Group for any expired Rewards.
- The GIG Group may at its sole discretion reject a Member's request to redeem Rewards for any valid reason, including but not limited to the following:
- There are insufficient GIG Points to redeem the particular Reward;
- The Reward is no longer available or is already out of stock according to the GIG Platform and/or its Partners; or
- The GIG Points intended for redemption have been issued in error.
- The GIG Group will not be liable for the product or service offered or provided as a Reward by its Partner(s). Any concern the Member may have regarding the Rewards after being redeemed with GIG Points shall be directed to the appropriate Partner.
- The Company, at any time and at its sole discretion, reserves the right to add, remove, modify or suspend any Rewards in the GIG Platform.
E. Privacy
- By becoming a Member of GIG Platform, the Member agrees, consents, and authorizes the GIG Platform to collect, record, organize, store, update or modify, retrieve, consult, use, access, consolidate, share, block, erase or destroy their transactional data, member activities, and personal data, including sensitive personal information, to provide statistical insights and conduct research and analysis to improve member experience, promotions, and satisfaction, facilitate account management, direct marketing, and availment of the services. In particular, the Member agrees and consents to the use of the Member's data for any of the following purposes:
- The Member will be the recipient of program-wide partner promotions that are offered to all Members of the GIG Platform. A program-wide partner promotion will provide temporary benefits to all Members that go beyond the standard earn or redemption mechanic of the Partner, if applicable, and includes but is not limited to an offer of additional GIG Points, a gift with purchase, exclusive or preferential access, and a special discount.
- The Member will be included in personalized partner promotions that cater to their shopping habits and other interests. A personalized partner promotion will provide temporary benefits to qualified members that go beyond the standard earn or redemption mechanic of the Partner, if applicable, and includes but is not limited to an offer of additional GIG Points, a gift with purchase, exclusive or preferential access, and a special discount.
- The Member may receive polls and surveys in order for the GIG Group and its Partners to collect information and gain insights that will be used to understand its Members better and provide better features, products, services, and promotions to its Members.
- To enable the sharing of the Member's personal data with its Partners that the Member has transacted with, for direct marketing purposes, including personalized partner promotions, polls, and surveys. This may be facilitated through contact points provided or availed of by the Member, and communicated via GIG Platform or its Partners' channels.
- Any other purposes enumerated in the Privacy Policy or as may be necessary and indispensable to effectuate such purposes.
- The Members acknowledge, agree, and consent that the GIG Group may notify or send program-wide and personalized partner promotions and offers as well as polls and surveys via contact points provided or availed by the Member which include but are not limited to SMS, social messaging apps, and in-app push notifications. The Members acknowledge that consent to receive information or notification on available program-wide promotions, offers, and requests to participate in program-wide polls and surveys is a core and integral feature of the GIG Platform and is required for continued membership in the Program. However, Members may opt out of personalized partner promotions, offers, and requests to participate in personalized polls and surveys by updating their preferences. To change or update their preferences, the Members may contact the representatives and administrators of the GIG Platform.
- Notwithstanding such an update, the Member will continue to receive program-wide promotions, offers, and requests to participate in program-wide polls and surveys but these may not be as personalized and relevant to the Member. If a Member no longer wishes to receive communications from the GIG Group and/or its Partners, the Members may cancel their membership by contacting the representatives and administrators of the GIG Platform.
- Moreover, the Member acknowledges, agrees, and consents that—without the need of additional notification or compensation—the GIG Group may disclose, share, transfer and/or sell your personal data or personal information, including sensitive personal information with affiliated and unaffiliated third parties. Such third parties may include business partners, advertisers, data brokers, marketing companies, analytics providers, AI companies, and other commercial entities. The GIG Group may disclose, share, transfer and sell personal data or personal information, including sensitive personal information with such third parties who shall be likewise legally and contractually bound to safeguard your privacy under applicable law. The Member further understands and agrees that once their personal data is transferred or sold to third parties, the GIG Group shall no longer have any control over or responsibility for how such third parties subsequently use, process, store, or further transfer or resell such data. The Member agrees and understands that the scope provided hereunder shall be to such extent, length and scope as may be necessary to achieve the purpose of the full transfer or sale of the personal data or personal information to a third party as discussed above.
- The Company has no control over the information the Members or possible members will provide and makes no representation as to their accuracy and veracity. The Company does not have the means to determine whether or not the information provided is complete, accurate, and/or authentic or if the Members or possible members would have the legal capacity to transact business with the GIG Group.
- If the information is provided about a minor or one who is not legally capable of entering into contractual transactions without parental or guardian consent, the parent or guardian is responsible for correcting any information given or for informing us that the information should be disregarded or deleted. To the maximum extent permitted by law and equity, the GIG Group shall not be liable for any loss, damage or injury whether direct, indirect or consequential, incidental, punitive, exemplary or any other loss, damage or injury arising out of or in connection with the inaccuracies, incompleteness, falsity or errors in the information provided by the Members or by minors or persons who are not legally capable of entering into contractual transactions.
F. Intellectual Property
- You acknowledge that all the intellectual property rights, including copyrights, patents, trademarks, and trade secrets, in the GIG Platform and its content are owned by the GIG Group or its Partners. Neither these Terms (nor your access to the GIG Platform) transfers to you or any third party any rights, title or interest in or to such intellectual property rights. The GIG Group and its Partners reserve all rights not granted in these Terms. There are no implied licenses granted to you under these Terms.
- Unless the prior written consent of GIG Group and its Partners have been obtained, you shall not remove or alter the trademarks, logos, copyright notices, serial numbers, labels, tags or other identifying marks, symbols, or legends affixed to any of the GIG Group's products and services.
- Where software applications, drivers, or other computer programs and/or all other design details, technical handbooks or manuals, drawings, or other data (all collectively referred to as “Materials”) are supplied to you by the Partner in connection with the rewards, the use and retention of the Materials are subject to the terms and conditions of license or use (such as end-user licenses, restrictions or conditions of use) as may be prescribed by the GIG Group, its Partners, or its third-party licensors and must not be used other than strictly in accordance with such terms and conditions.
- You agree and acknowledge that the Materials shall remain the property of the GIG Group, its Partners, or its third-party licensors. You further agree that any and all intellectual property rights embodied in or relating to the Materials shall remain the sole and exclusive property of the GIG Group, its Partners, or its third-party licensors.
- To the extent that it is desirable for the GIG Group to be able to provide or deliver the products, services or features of the GIG Platform, you hereby grant the Company the necessary worldwide and royalty-free license or sublicense to any intellectual property that (and their derivative works) that you may need to create, submit or provide to the GIG Platform in connection with any Quests or for such other uses or purposes.
- In certain Quests that require the submission of User Content, the Member grants the GIG Group a perpetual, worldwide, irrevocable, royalty-free, exclusive right to use, reproduce, modify, adapt, publish, translate, distribute, and display your content in any media now known or hereafter developed, in whole or in part, for any purpose, including but not limited to marketing, advertising, and other commercial purposes.
- By submitting, posting, or providing any User Content, including any materials, information, ideas, feedback, or other submissions on or through the GIG Platform, you hereby irrevocably transfer, assign, and convey to the Company all rights, title, and interest in and to such User Content, including without limitation all intellectual property rights therein on a perpetual, worldwide, irrevocable, royalty-free, and exclusive basis. The Member represents and warrants to have all necessary rights, licenses, consents, and permissions to grant the rights set forth in this provision, and that the User Content of the Member does not infringe the intellectual property rights or other rights of any third party.
G. Limitation of Liability and Indemnification
- The GIG Group shall have no liability whatsoever with respect to any damage, death, delay, injury or loss arising out of or in connection with the services, points or benefits provided or not provided by any of its Partners. The GIG Group shall not be liable for any loss or damage resulting from the termination or change in the Program or for any withdrawal from the program of any Partner. The GIG Group shall make reasonable efforts to inform the Members about any such changes or withdrawals as soon as possible. In the event it is determined that the GIG Group had been improperly denied any Reward, the exclusive remedy of the Member shall be the refund of any converted or redeemed GIG Points or any alternative and comparable benefit as determined by the GIG Group. The GIG Group shall not be liable for restrictions that may be imposed by the laws of certain countries on the implementation of the Program.
- To the maximum extent permitted by applicable law, in no event shall GIG Group be liable for any loss, injury, or damage, to persons or property whether direct, indirect, special, incidental, exemplary, or consequential, including lost profits, arising from the use or non-use of the GIG Platform and its products, features and services, the Quests, or any of the Partner's linked websites, goods, or services. In any case, in the event that a court of law determines with finality that a full waiver of liability is not allowed under applicable law or equity, in no case shall the GIG Group's liability exceed the value of the Rewards claimed by the Member or the amount of R10,000.00, whichever is lower.
- The Members agree and guarantee to defend, indemnify, and hold the GIG Group free and harmless from and against any charges, suits, damages, costs, expenses (including legal fees on a full indemnity basis), judgment, penalties, claims, liabilities, or losses of any kind or nature whatsoever, based upon or arising out of the use of GIG Platform.
H. Miscellaneous Provisions
- For more information, customer feedback or further assistance, the Members may contact the representatives and administrators of the GIG Platform through the following:
- Visit the web application or website at gigrewards.co.za; or
- Contact the GIG Group via email at support@gigrewards.com.
- For more information on how GIG Platform uses personal data provided by its Members, the Members may refer to the Privacy Policy.
- The GIG Group reserves the right to audit any membership accounts at any time without advance notice to ensure compliance with these Terms. If the audit or investigation determines or uncovers irregularities or suspicious activities which may be fraudulent or illegal in nature, the GIG Group may suspend the account of the Member in question for further investigation, or forfeit or deny any of the privileges given, or even terminate the account.
- The Company reserves the right to make Changes to the rules and structure of the Program, the Crown Reward Formula, membership benefits, redemption mechanics, whether wholly or partially, at any time and without prior notice, even if such Changes may affect the Member's ability to use the GIG Points that may have already been earned.
- The Company reserves the right to assign, transfer or delegate any of its rights and obligations herein to any third party without need of prior notice to or consent of the Members.
- The Members shall be responsible for any tax liability arising from their use of or any benefits they may derive from the GIG Points or the Program.
- You agree that the courts of Johannesburg, South Africa, to the exclusion of all other courts, shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with the subject matter or formation including non-contractual disputes or claims of these Terms (a “Dispute”). These Terms and any Disputes arising out of or in connection with their subject matter or formation shall be governed by and construed in accordance with the laws of the Republic of South Africa.
